Former UC-Davis Head Wrestling Coach Awarded $725,000 in Sex Discrimination Suit Settlement

Sacramento, CA - The American Association University Women Legal Advocacy Fund-supported plaintiff reached a final settlement agreement with the UC Regents on Jan. 19 after a nearly four-year struggle with the school system.

Michael Burch filed suit in 2003 for Title IX violations. The settlement awards him $725,000 for damages and attorney fees. Burch will not be reinstated as head wrestling coach at UC-Davis and is not permitted to pursue employment at any school in the University of California system.  

The UC Regents formally approved the settlement on Friday after reaching a tentative agreement in November 2006, just days before Burch's Dec. 5 trial date.

"AAUW is very pleased with Mike's settlement," said AAUW Legal Advocacy Fund Interim Director Lisa Maatz. "Mike stood up against discrimination - even when it cost him his job - and today, justice has been served."

Burch claims that UC-Davis barred female participation in the wrestling program and terminated his contract after he showed support for the female wrestlers in 2001. Burch's case is supported by the AAUW Legal Advocacy Fund, the nation's largest legal fund focused solely on sex discrimination in higher education. AAUW also supports the female wrestlers in a separate Title IX suit against the school.

"Mike should be applauded for his courage in standing firm to the very end of this difficult saga," Maatz said. "It's regrettable that the university didn't do right by him - and the female wrestlers - from the very beginning."

In 2003, Burch sued the Regents of the University of California and four university administrators for retaliation in violation of Title IX of the Education Amendments of 1972, the law that prohibits sex discrimination in education, and other federal laws. Since 2001, no women have participated in varsity wrestling at UC-Davis, despite the fact that two former UC-Davis female wrestlers won world championship medals. 
During his six-year tenure at UC-Davis, Burch was twice named "Men's Coach of the Year," led his team to more dual meet victories than any other previous wrestling coach at the school, recorded the first winning season at UCD in at least 25 years, and qualified numerous wrestlers to NCAA championships. In addition, he was a popular lecturer in religious studies and sports and society courses, where he touched on gender equity and Title IX.

Over the years, interest in women's wrestling has grown tremendously, debuting as an Olympic Sport in 2004.

Burch is now the assistant wrestling coach at Brown University and a religious studies lecturer at Rhode Island College and the Rhode Island School of Design

Iowa Teams Send UC Davis Home Early From NWCA National Duals

Kelly claims major decision and fall to lead UC Davis

Cedar Falls, IA – Competing against two of the best teams in the country at the
NWCA Cliff Keen National Duals, the UC Davis wrestling team was eliminated on the first day of
competition with tough losses to No. 5 Iowa and No. 24 Northern Iowa on Saturday. Senior Eliot
Kelly had the best overall day for the Aggies as he claimed two victories and a total of nine
points in the 197-pound class.

The two losses bring the Aggies’ dual record to 2-5 on the season.

UC Davis opened the grueling day against the No. 4 Iowa Hawkeyes. Competing
without No. 2 Derek Moore at 141 and No. 4 Ken Cook at 174, UC Davis struggled to match up
with a healthy Hawkeye team. Kelly earned UC Davis its only points of the match as he earned
an impressive 12-4 major decision against Rick Loera at 197. Nexi Delgado put in a solid
performance against Alex Tsirtsis at 141 and fell by just three points.

As if competing against the one of the top teams in the country wasn’t difficult
enough, the Aggies jumped back into action a couple hours later in the consolation bracket
against host school and No. 24-ranked Northern Iowa. Kelly continued to shine for UC Davis
at 197, and capped an impressive day when he pinned Andrew Anderson in 6:58. Fellow senior
Marcos Orozco earned the other points as he earned a four-point major decision at 125
over as he shutout Grant Ruge, 8-0.

The Aggies are back at it again next weekend as they host their first dual meet
this season when they welcome Pac-10 foe Cal State Fullerton to Hickey Gymnasium at 7:00 p.m. on
Friday.

Former UC-Davis Coach Sets Trial Date in Sex Discrimination Suit

AAUW Legal Advocacy Fund Supports Plaintiff

Sacramento, CA - The American Association University Women Legal Advocacy Fund-supported plaintiff will go to trial against the Regents of the University of California on December 5. Burch and the Regents had a settlement hearing on Nov. 20 but they were unable to reach an agreement.

Michael Burch, who filed for Title IX violations, alleges UC-Davis barred female participation in the wrestling program and terminated his contract after he showed support for the female wrestlers in 2001.
"AAUW is glad that Michael will have his rightly-deserved trial date," said AAUW Legal Advocacy Fund Interim Director Lisa Maatz. "Michael continues to stand up for people who have been wronged, and he should be applauded for doing so."

Burch's case is supported by the AAUW Legal Advocacy Fund, the nation's largest legal fund focused solely on sex discrimination in higher education.

UC Davis' Derek Moore and Ken Cook Both Advanced to Monday Night's Championship Finals

STANFORD, Calif. - Derek Moore and Ken Cook will both compete for Pac-10
wrestling titles on Monday evening after going undefeated on Friday, the first day of the Pac-10
Conference Championships being held at Stanford's Maples Pavilion. Five additional Aggie
wrestlers are still n the chase for third place in their respective weight brackets as UC Davis currently holds onto sixth place in the tournament.

No. 2 Moore (141) got the day started with a win over Boise State's Jordan
Brock. Moore took the immediate lead in the match with two takedowns and a near-fall in the first
period. Moore opened the second period with another early takedown before pinning Brock 4
minutes and 53 seconds into the match. In his evening match-up with No. 3 seed Matt Schumm of Cal State Bakersfield, Moore struck early and held the lead throughout the match taking
the 11-3 major decision win which advanced him to Monday evening's championship match versus No. 4 seed Dave Roberts of Cal Poly who Moore defeated in an 18-6 major decision on Feb.
17.

Ken Cook (174), who had not competed since January's dual against Cal State
Bakersfield, extended his winning streak to eight straight matches with a win over Ben
Gilliland of Boise State. Cook led early with a takedown and a three-point near-fall within the first
minute of the match, he followed with a second near-fall less than a minute later. In the second
period, Cook struck early and pinned Gilliland three minutes and 29 seconds into the match. Cook
finished the day with a 13-4 major decision win over No. 3 seed Christian Arellano of Cal State
Bakersfield to advance the 174-pound final against No. 1 seed, Oregon State's Jeremy Larson.

Marcos Orozco lost early in the day in a 125-pound pigtail to Zach Bigboy of Cal
State Bakersfield in an 8-2 decision. Orozco dropped into the wrestleback bracket in
the afternoon session where he faced Curtis Schurkamp of Cal State Fullerton. Orozco scored on
a takedown and near-fall in the first period to take an early 5-0 lead. Schurkamp made a
comeback in the second, tying the match following a reversal and near-fall. Orozco scored on a
takedown in the fourth and with the addition of a riding time point, he took the 8-6 victory. In
Orozco's second wrestleback match of the evening, he took on No. 5 seed Beau Malia of Oregon.
Orozco was on the attack from the beginning and pinned Malia in 59 seconds. Orozco will need
to defeat No. 3 seed Eric Stevenson of Oregon State on Monday morning to advance to the
125-pound third place match.

Omar Gaitan (133) also faced a loss early in the tournament to No. 3 Scott
Jorgeson of Boise State in a 11-6 decision, but Gaitan dominated both of his evening wrestleback
matches, taking a 19-9 major decision over Stanford's Eric Minnick followed by an 8-2 decision over John Espinosa of Arizona State. Gaitan will face No. 1 seed Justin Pearch of Oregon tomorrow morning.

Jon Clark, the Aggies 157-pounder, recovered from a 9-3 loss to No. 3 seed Tony
Hook of Oregon State by upsetting No. 5 seed Shawn Reilly in the afternoon session.
Clark grabbed an early takedown which was matched by Reilly to tie the score at 2-2, but Clark
fought back and came away with the 8-4 win. In his next match against Daniel Atondo of Cal State Bakersfield, Clark scored first on a takedown, but toward the end of the third period, the
score was tied at 3-3. With 30 seconds left to wrestle, Atondo scored on a takedown followed by a
near-fall to take an 8-3 win and eliminate Clark from the tournament.

Senior Jesse Padilla (149) also recovered from a loss in the morning session
with an upset win in the evening. Padilla was tied with No. 2 seed Tyler Sherfey of Boise State after the first period, but was unable to pull off the upset victory, instead he took a narrow 6-4 loss. Padilla made a comeback with a 14-2 major decision upset over No. 6 Orlando Perez in the
wrestleback bracket. Padilla will wrestle No. 5 seed Morgan Atkinson of Cal State Fullerton tomorrow
morning.

No. 4 Frank Richmond (165) opened up action against No. 5 Brian Busby at
165-pounds.Richmond grabbed a takedown less than a minute into the match and Busby followed
with an escape to bring the match to 2-1 at the end of the first period. Richmond opened
the second period with another takedown, but Busby scored on a reversal followed by a
near-fall to lead the match going into the third, 6-4. Richmond tied the match with 47 seconds left to wrestle, but Busby was able to pin Richmond with only 21 seconds remaining in the match to
grab the upset. In the wrestleback bracket Richmond faced Oregon's No. 1 Joey Bracamonte, who
faced an upset earlier in the day. Bracamonte scored first on a takedown late in the second
period but just before the buzzer signaled the end of the period, RIchmond scored a reversal to
tie the match at 2-2. Richmond chose the down position at the beginning of the third and scored
on a quick escape, but with just three seconds left, Bracamonte scored on a takedown to
grab the 4-3 win.

Redshirt freshman, No. 4 Tyler Bernacchi (184) won his first Pac-10 tournament
match with a decision over Cal State Bakersfield's Brandon Ceremello in a 6-3 decision. In
the following quarter final match, Bernacchi was upset by No. 5 seed Jesse Taylor of Cal State
Fullerton in a 8-1 decision. Bernacchi finished the day with an 11-3 major decision win over
Oregon State's Kyle Bressler. Bernacchi will face No. 3 seed, Cal Poly's Ryan Hasley, Monday
morning.

At 197-pounds, No. 5 seed Eliot Kelly dropped his quarterfinal match-up against
No. 4 Casey Phelps of Boise State despite leading for the majority of the match. Phelps
scored on a reversal at the end of the match and added a riding time point to his total to take a 7-5
decision. In his final match of the evening, Kelly and Jake Schneider of Portland State remained
scoreless for two entire periods before Kelly scored on an escape and took a 1-0 win.

Broc Maffia lost in a pigtail match versus No. 2 Ty Watterson of Oregon State in
a 5-1 decision in Sunday's first session. Maffia came back strong in his second match of the day,
taking a 3-0 lead in the second period over Matt Methling of Fullerton. Maffia took the 6-2 win by
decision over Methling before falling to No. 5 seed Arturo Basulto in the final match of the
evening.

The Aggies will continue competition at the Pac-10 Conference Championships at
11 a.m. Monday morning with championship finals being wrestled Monday evening at 6 p.m.
in Stanford's Maples Pavilion.

UC Davis Fall to Cal Poly in Final Pac-10 Dual of the Season

SAN LUIS OBISPO, Calif. - No. 10 Derek Moore's major decision win over David
Roberts in the 141-pound match was the highlight of UC Davis' 28-7 loss to Pac-10 rival Cal
Poly at the Mustang's Mott Gym Friday evening. Marcos Orozco posted the only other win for
the Aggies as UC Davis' season record fell to 7-9 overall and 4-5 in the Pac-10.

The Aggies got off to a rough start on Friday evening, dropping seven straight
matches before Orozco took his 8-3 win by decision over Cal Poly's John Hanks at 125-pounds. In the following match, Omar Gaitan dropped a 13-5 major decision to Darrell Vasquez, the Pac-10's No. 2 ranked 133-pounder. Vasquez has gone undefeated in the Pac-10 and is ranked No. 4 nationally.

Unranked Jon Clark led the Pac-10's No. 6 Ryan Williams 3-2 in the third period,
but Williams managed a two-point takedown with six seconds to go in the match to take the
narrow 4-3 decision at 157-pounds. In the following 165-pound match-up, No. 3 Frank
Richmond scored first on a takedown, but was ultimately upset by an unranked Rob Maxwell in a
7-5 decision.

In the 184-pound match-up, No. 6 Tyler Bernacchi was within one point of No. 3
Ryan Hasley with 1:45 left to wrestle in the third period. Hasley held onto the advantage
and grabbed a riding time point to defeat Bernacchi in a 4-2 decision.

In the 141-pound match-up, Moore scored on a takedown and a near-fall early in
the first period and did not look back. Moore, who is ranked No. 2 in the Pac-10, took an
18-6 major decision win over the No. 3 ranked David Roberts. Eliot Kelly, Broc Maffia and
Jesse Padilla each lost their respective matches in a decision.

The Aggies will face Fresno State in their final dual of the season on Saturday
evening in Fresno, Calif. The dual is scheduled to start at 7 p.m.

UC Davis 21, Oregon 19

DAVIS, Calif. - Jesse Padilla pinned Stewart Bogart one minute and 25
seconds into the 149-pound match to highlight UC Davis' 21-19 dual
win over Pac-10 foe Oregon on Friday evening at UC Davis' Pavilion.
The Aggies won five of the ten matches with Omar Gaitan, Derek Moore
and Dustin Noack each winning in major decisions.

The evening started with Oregon's Ryan Dunn taking a 21-8 major
decision over Marcos Orozco giving the Ducks the initial lead, but
things quickly turned for the Aggies in the 133-pound match as Omar
Gaitan scored on two near-falls in the first period against Beau
Malia. Gaitan held onto the lead through the remaining two periods
and came away with a 17-9 major decision, tying the dual score at 4-4.

No. 7 Derek Moore, who is currently ranked first in the Pac-10,
wrestled his way to a 12-1 major decision over the Pac-10's No. 4
ranked Skyler Woods. Moore scored on four takedowns and a near-fall
and also collected an impressive three minutes and 15 seconds of
riding time to help the Aggies gain the lead.

In the 157-pound match, freshman Dustin Noack collected his first win
of the season over Jeremy McLaughlin in a 12-3 major decision. Noack
had two three-point near-falls in the match and also collected a
couple minutes of riding time to assist him in the win.

Unranked Jon Clark who normally wrestles at 157-pounds, wrestled up a
bracket and had a well fought dual against the Pac-10's No. 1
wrestler, Joey Bracamonte. Bracamonte outscored Clark 4-2 in the
first period and each wrestler collected two points in the second. In
the third, Clark was able to keep Bracamonte scoreless and he came
away with a narrow 4-6 loss.

Eliot Kelly rounded out the wins for the Aggies in the 197-pound
match. Kelly scored on a reversal in the third to take a 2-0 lead. In
the following quarter, Kelly was able to add a two-point takedown to
earn a 4-0 decision over Tony Rolen. The final score was 21-19 in
favor of the Aggies.

"A couple of guys had some big wins for us tonight, most notably
Jesse Padilla. We beat a pretty good team and it is always nice to
beat a program as good as Oregon's," said head coach Lennie Zalesky
of the dual.

UC Davis' season record is lifted to 5-7 overall with a 3-3 Pac-10
record. The Ducks' overall record falls to 4-6 with a Pac-10 record
of 3-4.

The Aggies will be in competition again on Saturday as they take on
two more Pac-10 opponents at home. UC Davis will host Portland State
at 4:30 p.m. and Boise State at 7 p.m. in Upper Hickey Gym.

UC Davis Hand Stanford its First PAC-10 Loss

DAVIS, Calif. - No. 7 Derek Moore pinned Stanford's Juston Johnson
with 1:10 left in the the third and final period of the 141-pound
match to cap off the UC Davis wrestling team's 38-6 victory over
Stanford during the third annual "Beauty and the Beast" promotion
which featured the Pac-10 wrestling dual side-by-side the Aggie
gymnastic team's dual meet with Boise State at the UC Davis' Pavilion
Friday evening.

The Aggies grabbed the first win of the night as unranked Jon Clark
wrestled his way to an 8-2 decision over the Pac-10's No. 2 ranked
Scott Loescher of Stanford in the 157-pound match. Clark took an
early lead in the first period with two two-point takedowns and
sealed the win with another takedown in the third period.

Following Clark's match, Frank Richmond grabbed the second win of the
night for the Ags in the 165-pound match-up in a 15-6 major decision.
Richmond had three takedowns in the first period to gain an early
lead, he followed with two more takedowns in the second period and a
two-point near-fall.

The 174-pound match was forfeited by UC Davis to bring the dual score
to 7-6, but the score would not remain close for long. Tyler
Bernacchi was next up for the Aggies in the 184-pound match-up.
Bernacchi got on the board late in the first with a takedown with
only 59 seconds left to wrestle in the period, his opponent Ryan
Hagen managed an escape point with three seconds left in the first.

The second period remained scoreless, but Hagen chose the down
position at the beginning of the third and scored a quick escape
point to tie the match up at 2-2, neither wrestler was able to break
the tie in regulation periods so the match went into overtime.
Bernacchi was able to score a takedown in the extra time to grab the
4-2 win.

Ian Bork took an early lead in the 197-pound match with a takedown
and two-point near-fall in the first period, but Eliot Kelly
neutralized his opponent in the second as both wrestlers went
scoreless. In the third Kelly was awarded two back-to back stall
warning points while Bork scored an escape and a takedown. Kelly was
able to grab the win in the tail end of the match as he scored an
escape, a takedown and a penalty point. Kelly's 1:10 of riding time
made the difference as he took an 8-7 decision over Bork.

Evan Hendrix helped the Aggies further distance themselves from the
Cardinal as he used a reversal and near-fall in the third period of
the heavyweight match-up to take a 6-3 decision over Jared Boyer.

In the 133-pound match-up, Omar Gaitan wrestled his way to 22-10
major decision over Eric Minnick, accumulating an impressive 10
takedowns in the dual. Gaitan's win was followed up by Moore's pin in
the 141-pound match.

Stanford forfeited both the 125-pound match-up and the 149-pound
pairing to put the final score at 38-6 in favor of the Aggies.

UC Davis' dual record has been lifted to 4-6 with a 2-2 Pac-10
record. Stanford's season record drops to 5-4 and its Pac-10 record
now stands at 2-1.

The UC Davis wrestling team will finish its six dual homestand next
Friday, Feb. 3 when they host Oregon State at 2 p.m. and Oregon at 7
p.m., both duals will be held at Pavillion.

UC Davis Narrowly Drop Home Dual to Cal State Bakersfield, 20-19

DAVIS, Calif. -
In a dual that came down to the very last match, UC Davis fell to
Pac-10 opponent Cal State Bakersfield at home Saturday evening in
Hickey Gym. Aggie Derek Moore won by technical fall while Ken Cook
and Omar Gaitan each grabbed major decision victories as the Ags were
edged out by the Roadrunners, 20-19.

UC Davis got off to an early lead as No. 7 ranked Moore defeated
Bakersfield's Matt Schrumm using three takedowns and three near-falls
to accumulate a 17-1 technical fall 4 minutes and 37 seconds into the
141-pound match.

Following Moore's match, the Roadrunners took control of the dual,
winning both the 149-pound and 157-pound matches. Brandon Doyle used
four takedowns and 2 minutes and 38 seconds of riding time to defeat
Shawn Haratani (149) in a 14-5 major decision. In the next match,
Daniel Atondo defeated Jon Clark (157) in a 15-7 major decision that
gave the Roadrunners a narrow 8-5 lead.

The 165-pound match featured the Pac-10's No. 3 ranked Frank Richmond
versus No. 4 Brian Busby. Richmond added 1:11 of riding time to his
six takedowns to capture a 13-7 decision over Busby to tie up the
dual score up at 8-8.

No. 10 Ken Cook was up next in the 174-pound match where he collected
his eighth consecutive victory in a 13-5 major decision over the
Roadrunner's Garth Wara. Cook's win gave the Aggies a 12-8 lead, but
that lead was snapped in the 184-pound match when Bakersfield's
Brandon Ceremello pinned Tyler Bernacchi 1 minute and 41 seconds into
the match-up to give the Roadrunners a 14-12 advantage.

Eliot Kelly helped the Aggies regain the lead in the 197-pound
bracket when he held Colton Nichols scoreless for the entire first
period while simultaneously scoring two near-falls. With 3:05 of
riding time collected during the match, Kelly came away with a 12-6
decision once again giving the Aggies the lead at 15-14.

UC Davis was unable to capture wins in the next two matches as Eric
Parker collected a 9-3 decision over Broc Maffia (285) and Brandon
Zoeteway took a 11-4 decision over Marcos Orozco.

With the score at 20-15, the dual came down to the 133-pound match.
Despite scoring an evening high nine takedowns, Omar Gaitan's 20-8
major decision over Thomas Kimbrell was not enough to give the Aggies
the win. The final score was Cal State Bakersfield over UC Davis,
20-19.

The Aggies' season dual record is now 3-6 overall and 1-2 in the
Pac-10. The Roadrunners' record now stands at 3-5 overall and 2-2 in
the Pac-10.

UC Davis will be in action next Saturday, Jan. 27 when they compete
against Pac-10 opponent Stanford at the annual Beauty and the Beast
promotion where the wrestling dual will be held alongside the Aggie
gymnastic dual against Boise State. Beauty and the Beast will be held
at 7 p.m. at the Pavilion.

Moore Takes Second at Las Vegas Invitational

LAS VEGAS, Nev.-
No. 4 tournament seed Derek Moore was pinned by No. 3 seed Josh Churella of
Michigan 6 mintues 47 seconds into the 141 pound final match to highlight UC Davis action
on Saturday, the second and final day of the 24th annual Cliff Keen Las Vegas Invitational being
held at the Cashman Center. Moore and Ken Cook were the only two UC Davis wrestlers to
advance to the second day of the tournament, Cook placed eighth in the 174 pound bracket.

After going undefeated on Friday, Moore defeated No. 9 seed Kevin Artis in the
semifinal match in a 16-5 major decision on Saturday before falling to Churella in the finals. Cook, who lost in the quarter finals on Friday, started Saturday in thewrestleback bracket where he defeated Charlie Pipher of Western State in a 14-5 major decision. In the next round, Cook was defeated by Edinboro's Eric RIng in a tough 2-1 decision, which placed Cook in the seventh place match. In the seventh place match-up Cook defaulted against Lior Zamir of Penn to take eighth place.

UC Davis finished 18th overall out of 52 teams in competition with 46 points.
Michigan won the
tournament with a total of 145 points.

The Aggies will return to action on Friday, Dec. 9 when they host their first
home dual of the
season against San Francisco State at 7 p.m.
